TERMS AND CONDITIONS FOR APPOINTMENT AND GROUP CLASS BOOKINGS

 

 

These Terms and Conditions ("Terms") govern the booking and participation in appointments and group classes, as well as the use of the website, at Remedy This Health Clinic, a proprietary limited company located at 90 Rundle Street, Kent Town, SA 5067

 

Appointments may include, but are not limited to, acupuncture, naturopathy, counselling, or other allied health consultations, delivered in-person at the Clinic or online via Zoom. Group classes may include, but are not limited to, health and wellness workshops, naturopathic education, or holistic health sessions, delivered online via Zoom. All services are for professional allied health and wellness services and treatment only. By booking an appointment or group class, you ("Client" or "Participant", "you") agree to be bound by these Terms.

 

1. BOOKING AND PAYMENT

  • 1.1 Bookings for appointments and group classes must be made via My Zanda health software,  Wix.com, or other designated Clinic platforms.

  • 1.2 Payments must be made in Australian dollars (AUD) via accepted methods (e.g., credit/debit card, bank transfer). All prices are inclusive of GST unless otherwise stated.

  • 1.3 Bookings are confirmed only upon receipt of the required payment or deposit and are subject to availability. The Clinic reserves the right to refuse bookings for any lawful reason.

  • 1.4 Prices are subject to change without notice, but confirmed bookings will not be affected by subsequent price changes.

 

2. APPOINTMENTS

  • 2.1 Payment Requirements: (a) Zoom appointments require full payment at the time of booking to secure the appointment. (b) New patient appointments require a non-refundable deposit at the time of booking, as specified in My Zanda, Wix.com, or by the Clinic. (c) Other appointments (e.g., in-person for existing patients) may require payment at the time of service, unless otherwise specified.

  • 2.2 Cancellation and No-Show Policy: (a) Clients must notify the Clinic at least 24 hours in advance of their scheduled appointment time to cancel or reschedule without penalty. Notifications must be made to clinic@rthc.com.au, or by calling 08 8133 5981. (b) Cancellations made less than 24 hours before the appointment or no-shows will incur a $80.00 fee, charged to the Client’s nominated payment method or deducted from any session pack or deposit. (c) If cancellation is due to illness, a medical certificate must be provided within 48 hours to waive the $80.00 fee, subject to Clinic approval. (d) Repeated missed appointments (three or more within a 6-month period) may result in the Client being discharged from the Clinic’s services, at the Clinic’s discretion.

  • 2.3 Clinic Cancellations: The Clinic reserves the right to cancel or reschedule appointments due to unforeseen circumstances (e.g., practitioner unavailability, technical issues with Zoom). Clients will be notified promptly and offered a full refund of any payment or deposit, or the option to reschedule at no additional cost.

 

3. GROUP CLASSES/WORKSHOPS

  • 3.1 Payment Requirements: Group classes require full payment at the time of booking to secure participation, as specified in My Zanda, Wix.com or by the Clinic.

  • 3.2 Cancellation and No-Show Policy: (a) Participants must notify the Clinic of cancellations via My Zanda, email to clinic@rthc.com.au, or by calling 08 8133 5981 (b) Cancellations made more than 7 days before the class start date are eligible for a full refund, less a $25 administration fee. (c) Cancellations made 3–7 days before the class start date are eligible for a 50% refund or a credit toward a future class, at the Clinic’s discretion. (d) Cancellations made less than 3 days before the class start date or no-shows are non-refundable and non-transferable, except in exceptional circumstances (e.g., medical emergency, subject to Clinic approval and documentation). (e) If cancellation is due to illness, a medical certificate must be provided within 48 hours to waive any applicable fees or penalties, subject to Clinic approval.

  • 3.3 Clinic Cancellations: The Clinic reserves the right to cancel or reschedule group classes due to insufficient enrolment, instructor unavailability, or unforeseen circumstances (e.g., technical issues with Zoom). Participants will be notified promptly and offered a full refund or the option to transfer to another class at no additional cost.

  • 3.4 Class Delivery: Group classes are delivered online via Zoom. Participants must have a stable internet connection, a compatible device, and a Zoom account. The Clinic is not responsible for technical issues on the Participant’s end. Zoom meeting details (e.g., link, passcode) will be provided via email or My Zanda upon booking confirmation.

  • 3.5 The Clinic reserves the right to modify class content, instructors, or schedules with reasonable notice to Participants.

 

4. SESSION PACKS

  • 4.1 Session packs are available for purchase for specific appointment types (e.g., acupuncture, counselling) and are non-refundable.

  • 4.2 Session packs are valid for 3 months from the date of the first appointment and cannot be extended, except in exceptional circumstances at the Clinic’s discretion.

  • 4.3 Session packs cannot be used for naturopathic consultations, medications, or group classes.

  • 4.4 Session packs are non-transferable to other clients, family members, or third parties.

  • 4.5 Missed appointments or cancellations with less than 24 hours’ notice will be deducted from the session pack at the full appointment fee.

 

5. DEPOSITS

  • 5.1 New patient appointments require a non-refundable deposit at the time of booking, as specified in My Zanda or by the Clinic.

  • 5.2 Deposits are non-refundable, except where the Clinic cancels the appointment, in which case the deposit will be refunded or credited toward a rescheduled appointment.

  • 5.3 Appointments may be rescheduled at the Clinic’s discretion, subject to availability, without refunding the deposit.

 

6. CLIENT AND PARTICIPANT CONDUCT

  • 6.1 Clients must arrive on time for in-person appointments or join Zoom appointments promptly, and Participants must join Zoom group classes on time. Late arrivals may result in a shortened session or denied access without refund or rescheduling, at the Clinic’s discretion.

  • 6.2 For Zoom appointments and group classes, Clients and Participants must have a stable internet connection, a compatible device, and a Zoom account. The Clinic is not responsible for technical issues on the Client’s or Participant’s end.

  • 6.3 Clients and Participants must follow all instructions provided by the practitioner or instructor and adhere to Clinic policies, including virtual etiquette for Zoom sessions (e.g., muting when not speaking, using video where required).

  • 6.4 The Clinic reserves the right to refuse service, terminate an appointment, or remove a Participant from a group class for disruptive behaviour, non-compliance with protocols, or conduct that compromises the safety or experience of others, without refund.

 

7. HEALTH AND SAFETY

  • 7.1 Clients and Participants must disclose any medical conditions, injuries, or allergies that may affect their participation at the time of booking, via My Zanda or in writing to clinic@rthc.com.au.

  • 7.2 The Clinic adheres to Australian health regulations, including the Health Records and Information Privacy Act 2002 (SA). Clients and Participants are responsible for ensuring their health information is accurate and updated.

  • 7.3 For in-person appointments, Clients must comply with infection control measures (e.g., hand sanitising, mask-wearing if required) as directed by the Clinic or public health guidelines.

  • 7.4 For Zoom appointments and group classes, Participants must ensure a safe environment (e.g., stable seating, no physical hazards) and comply with practitioner or instructor guidance on activities (e.g., self-acupressure, stretching).

 

8. CONFIDENTIALITY AND PRIVACY

  • 8.1 The Clinic collects personal information (e.g., name, contact details, health information) for booking and service purposes, in accordance with the Privacy Act 1988 (Cth) and Health Records and Information Privacy Act 2002 (SA).


  • 8.2 Clients and Participants must not disclose confidential information shared during appointments or group classes (e.g., practitioner advice, personal stories, health details) to third parties, except as required by law.

  • 8.3 The Clinic will not share Client or Participant information with third parties without consent, except as necessary for service administration or legal compliance.

 

INTELLECTUAL PROPERTY

  • 9.1 All materials, including digital handouts, presentations, or Zoom content for appointments and group classes, are the intellectual property of Remedy This Health Clinic and are protected by copyright law.

  • 9.2 Clients and Participants may use materials for personal, non-commercial purposes only. Reproduction, distribution, or use for commercial purposes without written consent is prohibited. 9.3 Recording, screenshotting, or sharing Zoom appointments, group classes, or materials without prior written approval from the Clinic is strictly prohibited.

  • 9.4 Website Intellectual Property: The Clinic’s website (www.rthc.com.au), including but not limited to its text, images, logos, graphics, videos, design, layout, and functionality, is the intellectual property of Remedy This Health Clinic and is protected by Australian copyright, trademark, and other intellectual property laws. Users may access and view the website for personal, non-commercial purposes, such as obtaining information about services or making bookings. Any unauthorized use, including but not limited to copying, modifying, reproducing, distributing, or creating derivative works from the website’s content without prior written consent from the Clinic, is strictly prohibited and may result in legal action.

 

10. LIABILITY AND INDEMNITY

  • 10.1 Clients and Participants engage in appointments and group classes at their own risk. The Clinic, its employees, practitioners, and instructors are not liable for any personal injury, loss, or damage to property arising from participation, except where caused by the Clinic’s negligence.

  • 10.2 Clients and Participants agree to indemnify and hold harmless the Clinic, its officers, practitioners, and instructors from any claims, damages, or liabilities arising from their participation, negligence, or breach of these Terms.

  • 10.3 The Clinic maintains public liability insurance, but Clients and Participants are responsible for their own health insurance and any medical costs incurred.

11. DISPUTE RESOLUTION

  • 11.1 Any disputes arising from these Terms or participation in appointments or group classes shall be resolved through good-faith negotiation between the Client/Participant and the Clinic.

  • 11.2 If unresolved within 14 days, disputes may be referred to mediation in Adelaide, with costs shared equally.

  • 11.3 If mediation fails, disputes may be pursued in a court of competent jurisdiction in South Australia.

 

12. GENERAL PROVISIONS

  • 12.1 These Terms constitute the entire agreement between the Client/Participant and the Clinic and supersede any prior agreements.

  • 12.2 The Clinic may amend these Terms with 14 days’ notice via email or the Clinic’s website. Continued booking constitutes acceptance of updated Terms. 1

  • 2.3 These Terms are governed by the laws of South Australia and the Australian Consumer Law.

  • 12.4 If any provision is found invalid, the remaining provisions remain enforceable.

  • 12.5 Notices or inquiries should be sent to clinic@rthc.com.au or Remedy This Health Clinic, 90 Rundle Street, Kent Town, SA 5067.By booking an appointment or group class, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
